अनुसूचित जाति का व्यक्ति कब अपनी जमीन का विक्रय कर सकेगा?
धारा 98 उत्तर प्रदेश राजस्व संहिता के अनुसार-
अनुसूचित जाति के किसी भी भूमिधर को, कलेक्टर की लिखित पूर्व अनुज्ञा के बिना, कोई भी भूमि किसी अनुसूचित जाति से भिन्न किसी भी व्यक्ति को विक्रय, दान, बन्धक या पट्टे द्वारा अन्तरित करने का अधिकार नही होगा -
परन्तु यह कि कलेक्टर द्वारा ऐसी अनुज्ञा तभी दी जा सकेगी जब-
(क) अनुसूचित जाति के भूमिधर के पास धारा 108 की उपधारा (2) के खण्ड (क) अथवा धारा 110 के खण्ड (क) , जैसी भी स्थिति हो, में विर्निदिर्ष्ट कोई जीवित उत्तराधिकारी न हो।
(ख) अनुसूचित जाति का भूमिधर जिस जिले में अन्तरण के लिए प्रस्तावित भूमि स्थिति है, उससे भिन्न किसी जिले अथवा अन्य राज्य में किसी नौकरी अथवा किसी व्यापार , व्यवसाय, वृति या काराबार के निमित्त बस गया है या सामान्य तौर पर रहा है।
(ग) कलेक्टर को यह समाधान हो गया है कि विहित कारणों से भूमि के अन्तरण की अनुज्ञा देना आवश्यक है।
इस धारा के अधीन अनुमति प्रदान करने के प्रयोजनार्थ कलेक्टर द्वारा ऐसी जांच की जा सकती है जैसी कि विहित की जाय।
When can a Scheduled Caste person sell his land?
According to section 98 Uttar Pradesh Revenue Code-
No bhumidhar belonging to a Scheduled Caste shall have the right to transfer, by sale, gift, mortgage or lease, any land to any person other than a Scheduled Caste, without the previous permission in writing of the Collector -
Provided that such permission may be given by the Collector only if-
(a) a Scheduled Caste Bhumidhar does not have a living heir specified in clause (a) of sub-section (2) of section 108 or clause (a) of section 110, as the case may be.
(b) a Scheduled Caste bhumidhar has settled or has ordinarily resided in any district or other State other than the district in which the land proposed for transfer is situated for the purpose of any job or any trade, profession, profession or business.
(c) the Collector is satisfied that for the prescribed reasons, it is necessary to allow the transfer of the land.
For the purpose of granting permission under this section such inquiry may be made by the Collector as may be prescribed.
