पति या पत्नी न्यायिक पृथक्करण कब कर सकते है? हिन्दू विवाह अधिनियम 1955 की धारा 10 के अनुसार - विवाह के पक्षकारों में से कोई पक्षकार चाहे वह विवाह इस अधिनियम के प्रारम्भ के पूर्व अनुष्ठापित हुआ हो चाहे पश्चात् जिला न्यायालय को धारा 13 की उपधारा (1) में और पत्नी की दशा में उसी उपधारा (2) के अधीन विनिर्दिष्ट आधारों में से किसी ऐसे आधार पर, जिस पर विवाह - विच्छेद के लिए अर्जी उपस्थापित की जा सकती थी न्यायिक पृथककरण की डिक्री के लिए प्रार्थना करते हुए अर्जी उपस्थापित कर सकेगा। जहाँ कि न्यायिक पृथककरण के लिये आज्ञाप्ति दे दी गई है, वहाँ याचिकादाता आगे के लिये इस आभार के अधीन होगा कि प्रत्युत्तरदाता के साथ सहवास करे, किन्तु यदि न्यायालय दोनों में से किसी पक्षकार द्वारा याचिका के आवेदन पर ऐसी याचिका में किये गये कथनों की सत्यता के बारे में अपना समाधान हो जाने पर वैसा करना न्याय और युक्तियुक्त समझे तो वह आज्ञाप्ति का विखण्डन कर सकेगा। टिप्पणी कोई भी पक्षकार न्यायिक पृथककरण की याचिका निम्नलिखित में से किसी आधार पर प्रस्तुत कर सकते है- व्यभिचारिता का आचरण। क्रूरता। अभित्याग। धर्मपरिवर्तन। विकृतचित्तता। कोढ़। संचारी रतिजन्य रोग। सन्यासी होना। सात वर्ष से लापता होना। निम्नलिखित आधार केवल पत्नी को प्राप्त है- [धारा 13 (2) ]- पति द्वारा दूसरा विवाह करने पर। पति के बलात्संग या अप्राकृतिक मैथुन के दोषी होने पर। भरण-पोषण की डिक्री। यौवनावस्था का विकल्प। According to section 10 of the Hindu Marriage Act 1955 - 1.
