पीड़ित व्यक्ति कब अपने मुकदमें को एक जिले से दूसरे जिले के न्यायालय में ट्रांसफर करा सकेगा ? सिविल प्रक्रिया संहिता 1908 की धारा 24 के अनुसार- अन्तरण और प्रत्याहरण की साधारण शक्ति - किसी भी पक्षकार के आवेदन पर और पक्षकारों को सूचना देने के पश्चात और उनमें से जो सुनवाई के इच्छुक हों उनकों सुनने के पश्चात या ऐसी सूचना दिए बिना स्वप्रेरणा से, उच्च न्यायालय या जिला न्यायालय किसी भी प्रक्रम में- (क) ऐसे किसी वाद, अपील या अन्य कार्यवाही को, जो उसके सामने विचारण या निपटारे के लिए लम्बित है अपने अधीनस्थ ऐसे किसी न्यायालय को, अन्तरित कर सकेगा जो उसका विचारण करने या उसे निपटाने के लिए सक्षम है, अथवा (ख) अपने अधीनस्थ किसी न्यायालय में लम्बित किसी वाद, अपील या अन्य कार्यवाही का प्रत्याहरण कर सकेगा, तथा- (i) उसका विचारण या निपटारा कर सकेगा, अथवा (ii) अपने अधीनस्थ ऐसे किसी न्यायालय कोे उसका विचारण या निपटारा करने के लिए अन्तरित कर सकेगा, जो उसका विचारण करने या उसे निपटाने के लिए सक्षम है, अथवा (iii) विचारण या निपटारा करने के लिए उसी न्यायालय को उसका प्रत्यन्तरण कर सकेगा, जिससे उसका प्रत्याहरण किया गया था । 2. जहां किसी वाद या कार्यवाही का अन्तरण या प्रत्याहरण उपधारा (1) के अधीन किया गया है वहां वह न्यायालय , जिसे ऐसे वाद या कार्यवाही का तत्पश्चात विचारण करता है या उसे निपटाना है । अन्तरण आदेश में दिए गये विशेष निर्देशों के अधीन रहते हुए या तो उसका पुनः विचारण कर सकेगा या उस प्रक्रम से आगे कार्यवाही करेगा जहां से उसका अन्तरण या प्रत्याहरण किया गया था । 3.इस धार के प्रयोजनों के लिए- (क) अपर और सहायक न्यायाधीशों के न्यायालय , जिला न्यायालय के अधीनस्थ समझे जाएगें। (ख) कार्यवाही के अन्तर्गत किसी डिक्री या आदेश के निष्पादन के लिए कार्यवाही भी है। 4. किसी लघुवाद न्यायालय से इस धारा के अधीन अन्तरित या प्रत्याहृत किसी वाद का विचारण करने वाला न्यायालय ऐसे वाद के प्रयोजनों के लिए लघुवाद न्यायालय समझा जाएगा। 5. कोई वाद या कार्यवाही उस न्यायालय से इस धारा के अधीन अन्तरित की जा सकेगी जिसे उसका विचारण करने की अधिकारित नही है।
